Andréa Kọsta – E-commerce Terms & Conditions of Sale

These Terms & Conditions set out the basis on which we supply products to you through our website www.andreakosta.co.uk (“our site”). By placing an order, you agree to be bound by these Terms & Conditions, together with our Privacy Policy, Delivery Policy, and Returns Policy.

We recommend printing or saving a copy for future reference.

2. How the Contract is Formed

    • When you place an order, you will receive an email acknowledging receipt. This does not mean your order has been accepted
    • Acceptance takes place, and a binding contract is formed, when we send you a dispatch confirmation email
    • If part of your order is dispatched separately, a separate contract is formed for each dispatch

    3. Your Status

    By placing an order, you confirm that:

    • You are legally capable of entering into binding contracts; and
    • You are at least 18 years old

      4. Delivery

      • Delivery times, costs, and return information are set out in our Delivery & Returns Policy
      • We aim to dispatch all orders within the timeframe stated at checkout. Delays may occur during busy periods or due to events outside our control
      • Risk in the products passes to you on delivery. Ownership passes once we have received full payment

      5. Prices & Payment

      • All prices are shown in GBP and include VAT (where applicable)
      • Delivery charges are calculated at checkout
      • For orders shipped outside the UK, local import duties, taxes, and clearance fees are calculated in full at checkout using our tax and duty calculator. These must be paid at the time you place your order, and there will be no additional charges when your order is delivered
      • We take payment at the time you place your order

      6. Product Descriptions & Availability

      • We take care to ensure product descriptions, images, and pricing are accurate
      • Colours may vary slightly depending on your device’s display
      • All products are subject to availability, and we reserve the right to withdraw or substitute items at any time

      7. Your Right to Cancel (Consumer Contracts Regulations 2013)

      7.1 Right to Cancel

      If you are a consumer, you have the legal right to cancel your order within 14 calendar days from the date of purchase, without providing any reason.

      7.2 How to Request a Return

      To exercise your right to cancel, you must log in to your online account and submit a return request before the cancellation period expires.

      You must not send any items back until you have received written confirmation of approval via a return approval email.

      Once approved, you will receive instructions on how to complete your return using our DHL Returns Portal.

      7.3 Use of DHL Returns Service

      All returns must be processed using our DHL returns service. If a return is sent using an alternative courier — whether in error or without prior authorisation — you will be responsible for all return shipping costs, which will not be reimbursed, and we accept no liability for any loss, delay, or damage incurred in transit.

      7.4 Return Shipping Costs

      UK Returns

      • Return shipping cost: £7.99
      • This amount will be deducted from your refund when using our DHL returns service

      International Returns

      • Europe & USA: £29.99
      • Rest of World: £39.99

      When submitting a return request, the £7.99 UK return fee displayed in the Returns Portal is an estimate only.

      For returns originating outside the UK, the applicable international return fee will differ and will be confirmed in your return approval email prior to returning your item(s).

      7.5 Return Conditions

      Returned products must:

      • Be unused, unwashed, and in original condition
      • Include all tags, labels, and packaging
      • Be securely packaged to prevent damage in transit
      • Include the completed returns form provided in your original parcel

      Returns that do not comply with these requirements may be rejected and returned to you.

      7.6 Faulty or Incorrect Items

      If the item is faulty or incorrectly supplied, we will cover the cost of return and refund the original delivery charge. Please contact us prior to returning such items for authorisation and instructions.

      7.7 Refunds

      Refunds will be issued to the original payment method within 14 days of us receiving the returned products or acceptable proof of return.

      Please note:

      • Delivery charges are non-refundable unless the item is faulty or incorrectly supplied
      • Return shipping fees, where applicable, will be deducted from your refund

      Your statutory rights remain unaffected.

      8. Faulty or Damaged Products

      • Please inspect your order upon delivery
      • If your order arrives faulty, damaged, or incorrect, notify us in writing as soon as possible
      • We will arrange a replacement or refund in accordance with your legal rights

      9. Refunds

      • Refunds will be made to the original payment method only
      • Timescales for funds appearing in your account may vary depending on your payment provider (typically 5–10 business days)

      10. How We Use Your Information

      Your personal information is used in accordance with our Privacy Policy, which complies with UK GDPR.

      11. Our Liability to You

      We are responsible for foreseeable loss and damage caused by us. We are not liable for business losses, including loss of profit, revenue, or opportunity.

      We do not limit our liability for:

      • Death or personal injury caused by our negligence;
      • Fraud or fraudulent misrepresentation;
      • Breach of your legal rights in relation to the products

      Nothing in these Terms affects your statutory rights.

      12. Gift Cards

      Gift Cards are valid for 12 months from the date of purchase and can be redeemed both online at www.andreakosta.co.uk and in-store at Andréa Kọsta, 27 Duke Street, Liverpool, L1 5AP, in accordance with our Gift Card Terms of Use. Gift Cards are non-refundable, cannot be exchanged for cash, and cannot be used to purchase other gift cards. Please refer to the Gift Card Terms of Use for full details including delivery, redemption, and exclusions.

      13. Transfer of Rights and Obligations

      We may transfer our rights and obligations under these Terms to another organisation, for example in the event of a business sale or restructure. This will not affect your rights under your contract with us.
      You may not transfer your rights or obligations under your contract with us without our prior written consent.

      14. Severability

      If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision will be removed to the extent necessary. The remaining provisions will continue to be valid and enforceable.

      15. Changes to These Terms

      We may update these Terms from time to time. The version in force at the time you place your order will apply to that order.

      16. Communications

      We will contact you by email using the address provided at checkout. Formal notices can also be sent to our registered office.

      17. Third-Party Rights

      No one other than you and us has any rights under these Terms.

      18. Waiver

      If we do not insist immediately that you do anything you are required to do under these Terms, or delay in taking steps against you for breaching them, that does not mean we have waived our rights.

      19. Governing Law & Jurisdiction

      These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the English courts.

      20. Force Majeure

      We are not responsible for any delay or failure to perform our obligations under these Terms if caused by an event outside our reasonable control. This includes (but is not limited to) acts of God, natural disasters, extreme weather, war, terrorism, pandemics, epidemics, strikes, labour disputes, supply chain disruption, accidents, fire, flood, and actions of government or regulatory authorities.
      If such an event occurs, we will take reasonable steps to minimise the impact and will contact you to discuss any necessary changes to your order.
